Terms of Service – The Echo Chamber

This Terms of Service Agreement (the "Agreement") is entered into between Garry Marshall ("Bot Owner") and you, the user ("User"), of The Echo Chamber Discord bot (the "Bot").

By adding or using the Bot, you agree to be bound by this Agreement and by Discord's Terms of Service and Community Guidelines. If you do not agree, you should immediately stop using the Bot. You must be at least 13 years old, and old enough to use Discord in your country, to use the Bot.

Use of the Bot: The Bot Owner grants the User a non-exclusive, non-transferable, revocable, limited license to use the Bot for personal or non-commercial purposes.
Your Content: Memories, pictures, recollections, time capsule messages and anything else you add to an archive ("Content") remain yours. By adding Content, you give the Bot Owner permission to store it and to display it to members of the server where you added it (or, for private memories and letters to your future self, only to you), for as long as it is part of the archive. You can remove your Content at any time with /memory-delete or /forget-me.
Responsible Use: You are responsible for the Content you add. Don't preserve or share anything that is unlawful, harassing, hateful or sexually explicit, that infringes someone else's rights (including pictures you don't have the right to share), or that exposes another person's private information or photos without their consent. Remember that preserving a message keeps it visible to the server even after the original is deleted — please respect the wishes of the people involved. Server moderators can hide or remove memories, and the Bot Owner may remove Content or restrict access to the Bot where it is used against this Agreement.
Prohibited Use: The User may not use the Bot in any way that violates applicable laws, rules or regulations, that infringes upon the rights of any third party, or that abuses, disrupts, or attempts to gain unauthorized access to the Bot or its infrastructure. The User may not use the Bot for any commercial purposes without the express written consent of the Bot Owner.
No Warranty: The Bot is provided "as is" and "as available", without warranties of any kind, whether express or implied. The Bot Owner does not guarantee that the Bot will be uninterrupted, error-free, secure, or available at any particular time, or that time capsules or the Daily Echo will be delivered at an exact moment.
Limitation of Liability: To the maximum extent permitted by law, the Bot Owner shall not be liable for any damages arising out of the use or inability to use the Bot, including but not limited to damages for loss of profits, loss of data, or other intangible losses. Keeping your own copy with /echo-admin export is recommended for archives that matter to you.
Modifications to the Bot: The Bot Owner may modify, suspend, or discontinue the Bot at any time without notice. The User agrees that the Bot Owner shall not be liable to the User or any third party for any modification, suspension, or discontinuance of the Bot.
Intellectual Property: The Bot and all intellectual property rights therein, excluding User Content, are and shall remain the property of the Bot Owner. The User agrees not to copy, modify, or distribute the Bot or any portion thereof without the express written consent of the Bot Owner.
Indemnification: The User agrees to indemnify and hold harmless the Bot Owner from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of the User's use of the Bot or the Content the User adds.
Termination: This Agreement may be terminated by either party at any time for any reason. Upon termination, the User must immediately cease all use of the Bot. When the Bot is removed from a server, that server's archive is deleted after 30 days, as described in our Privacy Policy. Provisions that by their nature should survive termination — including Intellectual Property, No Warranty, Limitation of Liability, and Indemnification — will continue to apply.
Changes to these Terms: The Bot Owner may update this Agreement from time to time. The updated Agreement will be posted on this website, and continued use of the Bot after the changes take effect constitutes acceptance of the revised Agreement.
Governing Law: This Agreement is governed by and construed in accordance with the laws of Belgium, without regard to its conflict-of-law provisions. Where you use the Bot as a consumer, this does not deprive you of the protection afforded by the mandatory laws of your country of residence.
Entire Agreement: This Agreement, together with the Privacy Policy, constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or representations, whether written or oral, relating to the Bot.

By using the Bot, the User acknowledges that they have read this Agreement, understand it, and agree to be bound by its terms and conditions.
